Highlights

  • Employers (Contractors) and Unions (Crafts) may file grievances under the National Maintenance Agreements Policy Committee (NMAPC) Program for alleged violations of the National Maintenance Agreement (NMA).  Click here to reference NMAPC Grievance Review Procedure

 

  • Work shall proceed without interruption while the grievance process is running its course.

 

  • The NMAPC Grievance process is a five (5) step process commencing at the local level before being escalated to the NMAPC Grievance Review Subcommittee (GRS) under step four (4) of the Grievance Procedure.

 

  • Employers are advised to refrain from making protest payments until a formal decision has been rendered by the NMAPC Grievance Review Subcommittee. (Reference Policy Decision VI-1)

 

  • All grievances, except for jurisdictional disputes/work assignment disputes and those involving general wage rates, concerning the meaning or interpretation of this agreement shall be handled in accordance with this Article and its Grievance Procedure.
    • Disputes involving applicable wage rates are not covered under Article VI, rather the NMAPC Wage Appeals Subcommittee reviews and issues determinations for matters related to wage rates. (Reference Policy Decision VI-2)

Policy Decisions

  • VI-1 – Protest Payments Pending NMAPC Decision
    • Suggests that employers refrain from making protest payments until the NMAPC has determined the outcome of a grievance. Instead employers are instructed to place any monetary difference in escrow until a determination. has been issued by the NMAPC

 

 

  • VI-2 – Wage Appeals
    • Provides clarification and guidance when questions arise as to the correct/applicable wage rates contained in local collective bargaining agreements (Reference Article VIII – Wages as well as Policy Decisions VIII-4 “Two-tiered Wage Rates for Maintenance Work and Wage/Rate Site Modifications”; Policy Decision VIII-6 “Application of Pay Additives”; and VIII-10 “Current Labor Agreements.”
