Highlights

  • Wage rates paid under the National Maintenance Agreements (NMAs) are those found in the applicable craft’s local collective bargaining agreement (CBA) for the area where the work is to take place.
  • In the event that a local CBA calls for zone-type wage structures then the appropriate wage rate for NMA work shall be the base zone wage rate.

 

  • The National Maintenance Agreements Policy Committee (NMAPC) Wage Appeals Subcommittee reviews and issues determinations for questions related to wage rates (Reference Policy Decisions VI-2)
  • Wage rates can be modified under the NMA in accordance with Article XXVIII – Addenda To National Maintenance Agreement

Policy Decisions

  • VIII-1 – Lay-Off / Termination and Request for Time Extension on “Pay-Off”
    • Provides clarification of lay-off is pay-off and the penalties that may be awarded in the event an employer violates it.
  • VIII-2 – Establishment of Payday and Withholding Period
    • Provides clarification of when/how an employee should be paid after they voluntarily quit.
  • VIII-3 – Voluntary Quits
    • Standardized template to assist Employers, Unions and local building trades councils to document pre-job conferences
  • VIII-4 – Two-tiered Wage Rates for Maintenance Work and Wage / Rate Site Modifications
    • Provides clarification of the NMAPC’s long-standing policy to not recognize special wage rates specifically established for maintenance work.
  • VIII-5 – Payment of Wages and Check Cashing Charges
    • Provides clarification of how to address charges or service fees that a bank may collect from an employee cashing their paycheck.
  • VIII-6 – Application of Pay Additives
    • Provides clarification of the NMAPC’s policy on additive pay provisions contained in local collective bargaining agreements.
  • VIII-7 – Calculating Foreman’s Wages Subject to Wage/Rate Site Modifications
    • Provides clarification of how to properly calculate a foreman’s wages when working on a site with a wage rate modification.
  • VIII-8 – Calculating Wages Subject to Wage / Rate Site Modifications
    • Provides clarification of how to properly calculate employees’ wages when working on a site with a wage rate modification.

 

  • VIII-9 – Calculating Apprentice Wages Subject to Wage / Rate Site Modifications
    • Provides clarification of how to properly calculate apprentices’ wages when working on a site with a wage rate modification.
  • VIII-10 – Current Labor Agreement
    • Provides clarification that NMA wages shall be those contained in the local “building” agreement of the affiliated local union. It also discusses how other local agreement’s wages rates may apply and how the employer would need to qualify and get approval to use “other” wage rates.
  • VIII-11 – Conveyance of Previously Approved Wage Modifications
    • Provides clarification that wage rate modifications and other addendums shall remain in effect at a site where previously approved, after the site is sold to a different owner.
  • VIII-12 – Failure to Provide Proper Wage Payments on Payday
    • Provides clarification of instances when an employer fails to provide proper wage payment on payday as a result of unfunded checks.
  • VIII-13 – Employer Specific Pre-Hire Orientation and Training
    • Provides clarification that employees required to complete post hire orientation, testing or training shall be compensated the applicable wages and benefits.
  • VIII – 14 – Proper Implementation of an Approved Wage Modification
    • Provides clarification as to when an Employer may implement a Wage Modification once it has been approved by the NMAPC.
  • VIII – 15 – Application of Wage/Rate Site Modification and Shift Additives

    • Provides clarification concerning the application of wage/rate site modifications to second (2nd) and third (3rd) shift additives.
